Draft for review

Terms for Bucket

Last updated: [INSERT DATE]. These Terms govern access to and use of the Bucket web application, website, and related services. This page is a working draft and should be reviewed before public launch.

Bucket is currently in beta testing. We may change, suspend, or discontinue any part of the Service, including features, availability, storage limits, supported media types, and account functionality, at any time.

1. Description of Service

Bucket is a personal fitness logging web application that allows users to create, organize, and store a personal library of exercises, workout routines, media, and fitness notes for their own private use.

2. User Accounts and Eligibility

Age Requirement

You must be at least 18 years old to use Bucket. Bucket is not intended for individuals under 18, and you may not create an account or use the Service if you are under 18.

Account Security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account.

3. User Content and Uploads

You retain whatever copyright and ownership rights you already hold in the text, images, videos, or other files you upload to Bucket. By uploading content, you grant Bucket a non-exclusive, worldwide, royalty-free license to host, store, process, display, and back up that content solely for the purpose of operating, rendering, securing, and maintaining the Service for your account.

Bucket is designed for private, individual use. Your personal library is intended to be visible only to you. Bucket does not currently offer public directory listings, public file sharing, or user-to-user marketplace features.

Third-Party Materials

You may upload materials only if you own them, have permission to use them, or have another lawful basis to store them in your personal account. Bucket does not determine whether third-party materials may be copied, uploaded, or stored. You are responsible for ensuring that your uploads comply with copyright law and any terms that apply to those materials.

Image and Likeness Rights

You may not upload photos, videos, audio, names, likenesses, or other identifying information of another person unless you have that person's permission or another lawful basis to do so. Bucket will not use your uploaded photos, videos, or other personal content for marketing or promotional purposes without your permission.

Sensitive Content

Bucket is not intended to store medical records, diagnostic images, insurance documents, prescriptions, treatment notes, graphic injury images, nudity, sexual content, or images or videos of individuals under 18. Do not upload sensitive materials unless you have all rights, permissions, and legal authority required to do so.

Provider and Client Information

Bucket is intended for personal, individual use. If you use Bucket to store, upload, or manage information about another person, including a patient, client, child, family member, or training client, you represent that you have all rights, permissions, consents, and legal authority required to do so. Bucket is not intended to be used by healthcare providers as a medical record system, patient portal, clinical documentation system, or HIPAA-regulated service unless we enter into a separate written agreement stating otherwise.

4. Embedded Third-Party Media

The Service may allow you to save or embed third-party media links from supported platforms. If you save or embed media from third-party platforms, you are responsible for complying with the terms and policies of the platform where the media is hosted. Bucket does not host, control, or guarantee the availability of embedded third-party media.

If a creator or platform removes content, marks content private, disables embedding, changes access rules, or changes its service, the embedded media may become unavailable in your personal library.

5. Intellectual Property and Copyright Policy

The Bucket application, interface, branding, code, design, and related materials are owned by Bucket, its operator, or its licensors. These Terms do not grant you any right to copy, modify, distribute, sell, or create derivative works from Bucket except as necessary to use the Service as intended.

6. Data Hosting, Security, and Storage

Bucket may use third-party infrastructure providers for hosting, database, authentication, storage, email, support, monitoring, or related operations. We use reasonable administrative, technical, and organizational safeguards designed to protect user data, but no service can guarantee complete security.

Bucket does not currently use client-side end-to-end encryption. System administrators, service providers, or automated system tasks may access data when necessary to operate, secure, maintain, troubleshoot, or comply with legal obligations related to the Service.

You are encouraged to keep independent records of important workout data. Bucket is not liable for data loss, corruption, or unavailability resulting from account deletion, service disruptions, software errors, synchronization issues, hardware failure, unauthorized access, security incidents, or events outside our reasonable control.

7. Fitness, Health, and Data Accuracy Disclaimer

Bucket is an organizational and tracking tool. Bucket does not provide medical, health, physical therapy, rehabilitation, or professional fitness advice. Bucket is not a medical record system, patient portal, emergency service, or substitute for advice from a physician, physical therapist, trainer, or other qualified professional.

Physical exercise carries inherent risks, including serious bodily injury or death. You voluntarily assume all risks associated with your exercise routines, uploaded materials, notes, videos, and workout decisions.

You are responsible for independently verifying exercise instructions, loads, equipment weights, repetitions, durations, and safety considerations before performing any physical activity. Do not rely on Bucket as the sole source of truth for any exercise, weight, setting, routine, or safety instruction. Software errors, display inaccuracies, synchronization issues, data corruption, unauthorized access, security incidents, or other problems may cause information in Bucket to be incorrect, incomplete, outdated, or unavailable.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of applicable laws.
  • Upload malicious code, viruses, harmful files, or content that infringes another person's rights.
  • Attempt to gain unauthorized access to other accounts, systems, servers, databases, or infrastructure.
  • Reverse engineer, decompile, scrape, or attempt to extract the source code of the Service except where applicable law permits.
  • Use bots, crawlers, scrapers, scripts, automated tools, or other non-human access methods to access, copy, monitor, test, overload, create accounts, submit content, extract data, or interfere with the Service without our prior written permission. This restriction does not prohibit ordinary use of accessibility tools, browser features, password managers, or other tools that assist a user in personally using the Service as intended.
  • Use Bucket to provide medical care, clinical documentation, patient management, or regulated healthcare services unless we have entered into a separate written agreement allowing that use.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, or security.

10. Limitation of Liability

To the maximum extent permitted by law, Bucket, its operator, founders, officers, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or use, arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of $100 USD or the amount you paid us in the six months before the claim arose.

11. Termination

We may suspend or terminate your account or access to the Service at our discretion if we believe you violated these Terms, created risk for Bucket or others, or used the Service in a harmful, unlawful, or unauthorized way. You may stop using Bucket at any time.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

Before filing a legal claim, you agree to contact us at [INSERT SUPPORT EMAIL] and give us 30 days to try to resolve the dispute informally. If a dispute cannot be resolved informally, the state and federal courts located in Georgia will have exclusive jurisdiction, except that either party may bring an eligible claim in small claims court.

[COUNSEL REVIEW: Consider whether to include county-specific venue, a class action waiver, jury waiver, arbitration, or other dispute terms.]

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we may notify you by updating the "Last updated" date, posting a notice in the Service, or contacting you through the information associated with your account. Your continued use of the Service after changes become effective means you accept the updated Terms.
